These terms explain how Lensart credits work, when a failed generation results in a coin return, and the responsibilities that apply when using AI-generated portraits.
Section 01
By creating an account or using Lensart, you agree to these Terms of Use. If you do not agree with any part of these terms, do not use the service.
Use of the service also implies acceptance of our Privacy Policy, which is an integral part of these terms.
Section 02
Lensart is an artificial intelligence platform for generating professional portraits. The service allows you to:
- Train a personalized AI model with your photos
- Generate professional portraits in different styles (corporate, editorial, LinkedIn, etc.)
- Store and manage your generated images
Section 03
Lensart uses a coin-based credit system for portrait generation:
- Coins are purchased through one-time payments; there is no subscription.
- Purchases are final and not refundable for dissatisfaction with AI-generated results, including likeness, style, composition, or other artistic preferences.
- If a generation fails because of a technical or processing error and no portrait is delivered, the coin used for that failed generation will be returned to your account automatically.
- A returned coin is a service credit restoration for a failed generation, not a cash refund, except where applicable law requires otherwise.
- Coins do not expire while your account remains active.
- Each portrait generation consumes 1 coin per reference image used, with a minimum of 1 coin.
- Your coin balance is shown in the dashboard and updated in real time.
Section 04
As between you and Lensart, Lensart does not claim ownership of the images generated for your account, subject to the following conditions:
- You may use generated images for personal or commercial purposes, subject to applicable law, third-party rights, and the rules of any platform where you publish them.
- By using the service, you grant Lensart a limited license to store and display the images within the platform.
- Lensart does not guarantee that generated images are free from third-party claims or suitable for every professional, editorial, commercial, or platform-specific use.
- Content that infringes privacy, publicity, copyright, trademark, or other third-party rights remains the user's responsibility.
Section 05
You may not use Lensart to:
- Generate images of people without their consent
- Create defamatory, offensive, discriminatory, or illegal content
- Generate non-consensual nudity or sexual content involving minors
- Attempt to bypass the service's technical limitations
- Use the service for spam or fraud
- Resell access to the service without explicit authorization
Violation of these rules may result in immediate suspension or termination of the account.
Section 06
When you submit photos for model training:
- You represent that you own the rights to the submitted images or have authorization from the people depicted.
- You consent to the processing of those images by AI systems to create your personalized model.
- Third-party images without explicit consent are prohibited.
Section 07
Lensart is provided "as is" and we do not guarantee uninterrupted availability. We may perform scheduled or unscheduled maintenance with or without prior notice. We are not responsible for losses resulting from service unavailability.
Section 08
To the maximum extent permitted by law:
- Lensart is not liable for indirect, incidental, or consequential damages.
- Our total liability is limited to the amount paid by the user in the previous 12 months.
- We do not guarantee that generated images will meet every expectation regarding realism, likeness, style, commercial suitability, or editorial acceptance.
Section 09
You may request deletion of your account at any time by email. After deletion:
- Your access to the service ends immediately.
- Personal data and images are removed in accordance with our Privacy Policy.
- Unused coins are forfeited without refund.
Section 10
We may modify these terms at any time. We will notify users of material changes by email. Continued use of the service 30 days after notice constitutes acceptance of the updated terms.
Section 11
These terms are governed by the laws of Brazil. The courts of the District of Sao Paulo, SP, are elected as the forum for resolving any disputes arising from these terms.
